ALABAMA HOME SCHOOL LAW & LEGAL LINKS
Lake Forest Home School Club provides a separate home school organization. We are not a covering. There is no specific nor general requirement nor prohibition in Alabama law regulating home school. However, state and local authorities have generally recognized homeschooling in two ways, viz., by Private Tutor Method or Church School Satellite Method.
State amendment 16-28-3 compulsory age law, Church School requirement for attendance for children between the ages of 7 & 17.
State amendment 16-8-7 requires reporting of attendance by Church Schools to the public school superintendent and notification of withdrawal from the church school.
State amendment 16-28-15 requires explanations to be given for absences of a student on a school day.
Finally, State amendment 16-28-16 requires a truancy officer to give the parents a 3 day notice whereby the parent can become compliant with state law and contact counsel to avoid criminal prosecution proceedings.
It is furthermore recommended that home-schoolers keep a copy of attendance records, grades or progress reports and a portfolio of samples of school work by each child.
The Alabama Constitution amended in 1998 provides for the Alabama Religious Freedom Act, Amendment 622 providing additional protection for religious based home schooling choices.
We recommend making donations to: Southeast Law Institute www.southeastlawinstitute.org , 205-408-8893. They are a non-profit organization that defend the rights of Alabama citizens for free. Unlike the HSLDA you are not buying an insurance plan for representation as the Southeast Law Institute reserves the right to decline to take a case, but there record shows, that they have not to date, ever declined to take a home school case. They have been involved in home school law since the 1980's and are aware of unique circumstances in our state. They specialize in parent rights, religious freedoms, sanctity of human life, free speech (especially in public schools) and constitutional & public issues. Visit their website for more information.
